CHICAGO – Attorney General Kwame Raoul, as part of a bipartisan coalition of 47 attorneys general, is urging consumers to check their eligibility for compensation for certain generic drug purchases, and to submit a claim for compensation.
Raoul and the coalition filed to seek preliminary approval to distribute settlement funds paid by generic drug manufacturers in exchange for the settlement of claims that those companies illegally conspired to raise the prices of generic drugs, which the U.S. District Court for the District of Connecticut granted this month.

“I urge consumers in Illinois and across the nation to review the list of medications they may have taken between May 2009 and December 2019 to determine their eligibility for compensation,” Raoul said. “It has been a long road of lawsuits and settlements to hold multiple drug companies accountable for outrageous profits at the expense of residents who rely on, what are supposed to be, more affordable drugs. Now is the time for consumers to take action to submit a claim for the compensation they deserve.”
Today’s announcement comes after Raoul and the coalition filed three separate lawsuits against nearly 50 large generic drug manufacturers, alleging they engaged in a systematic campaign to conspire with each other to fix prices, allocate markets and rig bids for hundreds of different generic drugs of all types.
Raoul’s lawsuits alleged a scheme in which executives of competing companies would negotiate illegal agreements during industry dinners, trade shows and customer conferences. They also communicated via frequent telephone calls, emails and text messages where they discussed allocating customers and coordinating price increases on the products they had in common. Throughout this conspiracy, defendants used terms like “fair share,” “playing fair” and “rules of engagement” to describe how they unlawfully discouraged competition, raised prices and enforced an ingrained culture of collusion.
Raoul and the coalition previously announced settlements with the manufacturers Glenmark, Lannett, Bausch, Apotex, Heritage and Heritage’s parent company, Emcure, totaling approximately $96.5 million. The multistate coalition’s distribution plan aims to return millions of dollars from those settlement funds to individuals potentially harmed by the elevated prices of the generic drugs that are the subjects of the settlements.
